I have 17 years experience serving small and mid-size businesses entrepreneurs and individuals exclusively focusing on business-related legal issues. I am well-qualified to handle your case from inception through trial if necessary. In most cases I recommend first considering the possibility of Alternative Dispute Resolution (ADR). ADR includes mediation judicial arbitration informal settlement and early settlement conferences. ADR is becoming more prevalent even among large corporations including those with substantial legal budgets. The alternatives are litigation often prolonged or trial where the real winners will likely be attorneys. Of course the parties must agree to ADR and some parties simply will not do so. In that event I am proficient at both litigation and trial. A lawsuit involves substantive law and procedural law. Substantive law governs the legal principles of your dispute for example contracts law. To be effective at substantive law an attorney must possess strong research analytic and writing skills. Objective measurement shows that my abilities in those specialties are in the 95th percentile. Procedural law sometimes known as lawyers law governs how a lawsuit proceeds through the court. Curiously many attorneys especially younger ones are paying procedure less attention. While procedure is somewhat dull I find that it s relatively easy to prevail on a well-reasoned procedural law motion which creates opportunities to weaken or even defeat your opponent s case. Trial requires a good grasp of both substantive and procedural law. More importantly trial requires the ability to persuasively present your case to a judge or jury. Prior to becoming an attorney I was a business executive responsible for business expansion. New business pitches and presentations are quite similar to trial arguments. It s just that instead of selling a business firms capabilities I now sell the legal merits of my clients cases. I frankly attempt to avoid trial if possible because it s so expensive. Even the large insurance companies I represented while working for large law firms seek to avoid the cost of trial. FEES A large firm would likely bill my time at 395 to 495 per hour. But I grew tired of working for firms capitalized on emerging technologies and became a sole practitioner. I now bill lower fees but enjoy life more. I vary my rates according to the case but I rarely charge more than 195 per hour. If it appears there might be a favorable outcome I often charge a modest hourly fee with a contingency agreement.
